This standard terms and conditions for Sale Agreement (“Agreement”) contains the terms and conditions that apply to any order, purchase, receipt, delivery, use of any Computer system(s) and/or any related AVELL products and/or services and support sold in the United States (“Product”) from AVELL Corporation and or any of its subsidiaries or affiliates (collectively, “AVELL”), and is also a legal contract between Customer and AVELL.

The customer by accepting delivery of the product(s) purchased from AVELL and described on your invoice, you agree to be bound by and accept the following terms and conditions. Any attempt to alter, supplement or amend this document or to enter an order for a product that is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both you and AVELL. These terms and conditions are subject to change without prior written notice at any time, in AVELL’s sole discretion.

This Sale Agreement constitutes the entire agreement between the customer and AVELL relating to the purchase or sale of goods or services on the website. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the website in a writing signed by AVELL. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement.  

AVELL may at any time revise these terms and conditions of Use and or are by subject to change without prior written notice at any time, in AVELL's sole discretion. By using this Site, you agree to be bound by any and all such revisions and should therefore periodically visit this page to determine the then current Terms and conditions set forth to which you are bound.

 

RETURN IN REGRET OR DISCONTINUANCE

For discontinuance before the receipt of the product, you should refuse the product upon delivery and notify the Avell, who will provide the cancellation within 10 days after the receipt of the product in the distribution center.

If you receive the product and you want discontinuance of the purchase, you have the right to return it and receive the refund of the value of your order. The deadline for discontinuance of purchase is 7 (seven) days of receipt of the product. The order only will be to canceled if the product has not evidence of use, accompanied by invoice, manual and all accessories.

Avell will make the order cancellation after analysis of the product. The analysis will be performed within 07 (seven) business days, from the date of the product receipt.

 

INDEMNITY EXCHANGE ORDER CANCELLED

If the product meets the above requirements, the Avell will make the refund of amounts paid, by default, using the same payment method chosen in the purchasing process:

• On purchases paid with credit card, the administrator of your card will be notified and the reversal will occur in up to two subsequent invoices.

IMPORTANT: in case of return, the refund of values will be processed only upon receipt and analysis of the conditions Product in our Distribution Center.

The refund will be issued in the total amount of product returned/canceled, adding to the freight charge.

Avell exempts itself of obligation to cancel or repair any product that clearly presents signs of misuse.

 

RETURN AND EXCHANGE POLICY

REPLACEMENT OF THE PRODUCT - DIVERGENCE OF MODEL and/or FAULT IN QUALITY

Verify the product together with the carrier upon delivery. If there is any fault in the product or the quality of delivery, refuse and record on the reverse side of the invoice the reason for return. Do not sign any other document.

Once notified by the carrier on the return, our team will provide a new request with the shipping product.

If you receive a product that presents any divergence, it is necessary that the product is no evidence of use, accompanied by invoice, manual and all accessories for we can replacement by another product of the same kind (brand and model). REPLACING THE DEFECTIVE PRODUCT

A request for return must to be reported to our Customer Service Center up to seven (7) days, counting from the date of receipt. Within that period the client has the right to request a replacement, provided accompanied by invoice, manual and all its accessories and the product is no evidence of misuse.

The term for collecting the product will be informed through email or phone. AVELL will analyses the products, that may be return without prior consultation in case of noncompliance with the criteria listed above or is not found any defect.

If the product purchased on our website fails after seven (07) days from the date of receipt, but within the warranty period of the product, you must contact our service center to report it and get clarification. If you want, you can also go to one of our factory, with the invoice.

Terms

Avell sends the product conform the payment option selected by customer at of purchase. It also depend on the receipt of payment by the bank or the date of approval of the debt (for purchases made by credit card). It also depends of availability of the items purchased with the product, as different components of the standard.

PROCEDURE FOR DELIVERY

Avell will deliver your product in informed consultation terms by our consultants. If the carrier can not find anyone at the location indicated, it will make up to three attempts.

Confirm the action with the packaging of the product purchased, it is compatible with the measures passing the delivery address, passing through doors, gates, lifts and stairs. Shipping, handling and tax are additional unless otherwise expressly indicated at the time of sale. Title to products passes from Avell to Customer upon shipment to Customer. Loss or damage that occurs during shipping by a carrier selected by Avell is Avell's responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. You must notify Avell within 21 days of the date of your invoice or acknowledgement if you believe any part of your purchase is missing, wrong or damaged. Unless you provide Avell with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship to location, you are responsible for sales and other taxes associated with the order. Shipping and delivery dates are estimates only.


DELIVERY OF TWO OR MORE PRODUCTS

SITUATIONS THAT CAN CHANGE THE DELIVERY TERM

I HAVE NOT RECEIVED MY PRODUCT YET

DISCLAIMER:

For payments by credit card, the deadline for submission must to be considered as confirmation of payment and release of your order.

No receiver:

Check the status of your order and your email. If it has any information about unsuccessful delivery attempt by Avell, we ask you wait up to 48 hours. In this period, we will make 3 attempts to deliver a row.

After the attempts at delivery, if there is no one to receive the order, it will return to the distribution center Avell and you will receive a notification.

Carriers of Avell are advised to post a notice indicating that they were at your residence. You can follow the guidelines outlined in this document.

In case of apartment, check with the concierge if the product has been delivered.

Rejection of the application:

Your credit card has a purchase limit set by the administrator. SHIPPING

The shipping value is calculated based on delivery location, weight and dimensions of each product purchased.

To calculate the freight value:

Select OK and the freight value will be updated.

The FREE SHIPPING includes only products that participate in any promotional activity, described in Avell website or in any promotional material sent by the store.

If you purchase in the same order another product out of the promotion, the shipping value of this product will be charged normally.

 

Warranty

To assurance your tranquility, Avell offers 1 Year of Warranty to guarantee coverage of expenses for repairs or replacement of parts, defective parts or battery, and 3 Years concerning the labor on your product.

The warranty is valid only in national territory. The customer is responsible for covering the expenses of sending abroad or taxes about replacement product, as well as their proper components.

The Insurance Extended Warranty Differentiated coverage period described in the Certificate of Insurance Policy and its onset is from issuance of Invoice having validity over the next 12 months.

WARRANTIES (WHAT IS COVERED)

The basic coverage of the insurance Extension of differentiated warranty covers the compensation of total labor costs and parts replacement or components for the repair of the affected product by the occurrence of a defect.
