PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS.

This standard terms and conditions for Sales Agreement (“Agreement”) contains the terms and conditions that apply to any order, purchase, receipt, delivery, use of any Computer system(s) and/or any related AVELL products and/or services and support sold in the United States (“Product”) from AVELL Corporation and/or any of its subsidiaries or affiliates (collectively, “AVELL”), and is also a legal contract between the Customer and AVELL.

The customer by accepting delivery of the product(s) purchased from AVELL and described on your invoice, you agree to be bound by and accept the following terms and conditions. Any attempt to alter, supplement or amend this document or to enter an order for a product that is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both you and AVELL. These terms and conditions are subject to change without prior written notice at any time, in AVELL’s sole discretion.

This Sales Agreement constitutes the entire agreement between the customer and AVELL relating to the purchase or sale of goods or services on the website. The Sales Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the website in writing and signed by AVELL. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement.  

AVELL may at any time revise these terms and conditions of Use and they are subject to change without prior written notice at any time, in AVELL's sole discretion. By using this Site, you agree to be bound by any and all such revisions and should therefore periodically visit this page to determine the then current Terms and conditions set forth to which you are bound.

 

RETURN BY REGRET OR WITHDRAWAL

For withdrawal before receipt of the product, you should refuse the product upon delivery and notify Avell, who will provide the cancellation within 10 days after the receipt of the product in the distribution center.

If you receive the product and you want to withdraw the purchase, you have the right to return it and receive the refund of the value of your order. The deadline for purchase withdrawal is 7 (seven) days of receipt of the product. The order only will be canceled if the product has no evidence of use, accompanied by invoice, manual and all accessories.

Avell will make the order cancellation after analysis of the product. The analysis will be performed within 07 (seven) business days, from the date of the product receipt.

 

REIMBURSEMENT FOR CANCELLED ORDERS

If the product meets the above requirements, Avell will refund the amounts paid, by default, using the same payment method chosen in the purchasing process:

• On purchases paid with credit card, the administrator of your card will be notified and the reversal will occur in up to two subsequent bills.

IMPORTANT: in case of return, payment refund will be processed only upon receipt and analysis of the Product's conditions in our Distribution Center.

The refund will be issued in the total amount of the product returned/canceled, plus shipping costs.

Avell exempts itself of obligation to cancel or repair any product that clearly presents signs of misuse.

 

RETURN AND EXCHANGE POLICY

Guarantee the satisfaction of our customers is part of Avell's mission. We created a "Exchange and Returns Policy" for your rights to be respected, based on the Consumer Protection Code, demonstrating that the relationship between you and Avell is based on trust. All requests involving return and exchange should be communicated directly to our Customer Service through one of the available contact options. PRODUCT REPLACEMENT - DIVERGENCE OF MODEL and/or FAULT IN QUALITY

Verify the product together with the carrier upon delivery. If there is any fault in the product or the quality of delivery, refuse and record on the reverse side of the invoice the reason for return. Do not sign any other document.

Once notified by the carrier on the return, our team will provide a new request with the shipping product.

If you receive a product that presents any divergence, it is necessary that the product has no evidence of use, accompanied by invoice, manual and all accessories so we can replace it by another product of the same kind (brand and model). The terms to call our Customer Support Center is 07 (seven) days of receipt of the product. The exchange or order cancellation will only be made after analysis of the product by AVELL. Procedures to collect the product at the same address will be informed to you through email or phone. Performing the exchange will depend on the availability of the same model of the product in our stock and will be informed through email or phone. If the product is out of stock, another similar product of the same value may replace it. However, if you do not want the same product, you have the right to request the cancellation of purchase or even choose another model by paying the difference.

 

REPLACING THE DEFECTIVE PRODUCT

A request for return must to be reported to our Customer Service Center up to seven (7) days, counting from the date of receipt. Within that period the client has the right to request a replacement, provided the product originally purchased accompanied by invoice, manual and all its accessories and the product has no evidence of misuse.

The period for collecting the product will be informed through email or phone. AVELL will analyze the products, that may be returned without prior consultation in case of noncompliance with the criteria listed above or if no defect is found.

If the product purchased on our website fails after seven (07) days from the date of receipt, but within the warranty period of the product, you must contact our service center to report it and get clarification. If you want, you can also go to one of our factories, with the invoice.

Delivery Time

Avell sends the product as the payment option selected by customer at purchase. It also depend on receipt of payment by the bank or the date of approval of transaction (for purchases made by credit card). It also depends of availability of the items purchased with the product, when considering different components from the standard models.

Delivery time varies by region: you can check this information with one of our consultants by chat or phone.


PROCEDURE FOR DELIVERY

Avell will deliver your product bt the deadline informed by our consultants. If the carrier can not find anyone at the location indicated, it will make up to three attempts.

Check the measurements of the packaging of the product purchased, if they are compatible with the measurements at the delivery address, for example if it can pass through doors, gates, lifts and stairs. We are not responsible for hiring and payment of business services for lifts, manpower for internal transportation at the delivery address or hiring manpower for technical assistance, removal of the packaging and product parts.

If the delivery service is not completed and/or is unable to locate the address, Avell will contact you by email or phone to confirm the address.

Shipping, handling and tax are additional unless otherwise expressly indicated at the time of sale. Title to products passes from Avell to Customer upon shipment to Customer. Loss or damage that occurs during shipping by a carrier selected by Avell is Avell's responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. You must notify Avell within 21 days of the date of your invoice or acknowledgement if you believe any part of your purchase is missing, wrong or damaged. Unless you provide Avell with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship to location, you are responsible for sales and other taxes associated with the order. Shipping and delivery dates are estimates only.


DELIVERY OF TWO OR MORE PRODUCTS

If there are two or more products in the same order, the delivery can be carried out in two shipments, as the size of the product and its availability in stock.

MY PURCHASES

In "My Orders", you can follow the processing of your order.

Select "My Account" at the top menu on the Avell website, sign in with your email and password.

On that page, you can to check the status of all your orders.

• My Orders: It will display all orders placed on the Avell website, including the current status.

• Pending Payment: Awaiting authorization by your financial institution, as well as confirmation of Policy Analysis as disclosed on our website.

• Track Order: To track your order based on the tracking number emailed by our consultants.

Our system automatically sends e-mail alerts notifying you of any changes in processing the application. To receive them, it is important to keep your updated email in your account.

 

SITUATIONS THAT CAN CHANGE THE DELIVERY TIME

• Inconsistency in reported data when registering.

• Difficulties in validating registration data to release the order.

• Availability of product inventory or items added in its configuration.

• No one available to receive the product at the delivery location.

• Refusal on receipt of the goods by third parties.

• Circumstances beyond our control such as rain, accidents, among others.

• Notice by our couriers indicating issues with the quality of the packaging or product.

• Need to hire and pay for lifting services, work force for internal transportation at the delivery address or hiring work force for technical assistance, removal of the packaging and product parts.

• If they notice any difficulty, our couriers immediately will inform Avell that will contact the consumer through email or phone, to confirm and complete the data, completing the delivery and arranging cancellation or return of the amounts paid. Tip: incorrect or incomplete data can cause unnecessary delay. Keep your records updated.

• Products, consumer goods, books, and electronic media programs involving tax interests  must be sbmitted to tax authorities. Therefore, the tax authority has the power to examine and seize them, even without legal authorization.

I HAVE NOT RECEIVED MY PRODUCT YET

Check below what might have happened:

Delivery date:

Check the expected delivery date of your order, as information provided by our consultants.

Address data:

Confirm the delivery address.

Payment:

Confirm that your request has been approved by the financial institution selected for payment.

 

DISCLAIMER:

For payments by credit card, please remember that the delivery period starts at confirmation of payment and release of your order.

Person available to receive delivery:

Check the status of your order and your email. If it has any information about unsuccessful delivery attempts by Avell, we ask you wait up to 48 hours. In this period, we will make 3 delivery attempts.

After the delivery attempts, if there is no one available to receive the order, it will return to the Avell distribution center and you will receive a notification.

Carriers of Avell are advised to post a notice indicating that they were at your residence. You can follow the guidelines outlined in this document.

In case of apartments, check with the building manager if the product has been delivered.

Rejection of delivery:

Make sure that the people in charge of receiving the shipment do not refuse to receive it.

Circumstances out of our control:

Make sure that in the days scheduled for delivery, there were no storms or accidents in the region where the product should be delivered, preventing the arrival of the carrier.

Confirm in the email address informed in your account if you have not received an email from Avell informing rescheduling of the delivery date.

Avell has a trained team to clarify and resolve any occurrence that could compromise the delivery date informed at purchase. If your questions are not resolved through our site, please contact us through our customer service channels.

Seizure of Goods by Tax Authorities:

Merchandise, consumer goods, books and electronics involving tax interests must be submitted to tax authorities. Therefore, the tax authority has the power to examine and seize them, even without legal authorization.

If there are any issues, our team at Avell will contact you by email or phone to confirm and complete the data / regularize pending items and complete delivery and/or arrange cancellation and refund of paid amounts.

 

PAYMENT ACCEPTED 

Payment options can be changed without notice. Check them before making the purchase. You can pay for your order in the following ways:

Payment in installments:

Paypal: Credit Card - Visa, Mastercard

 

CREDIT CARD OPTION

Put the product in the shopping cart and insert your email and password. Then, you will be directed to the payment screen of the application.

• Select the CREDIT CARD option  Visa or MasterCard if you choose payment through Paypal.

• Insert the data as on your credit card.

• Select CONTINUE to be directed to the final confirmation screen where you can check your order data. Confirm your purchase and finalize it.

To further enhance security for our customers, the payment service administrator, Paypal, checks the registration information of the orders paid by credit card.

If there are issues with the registration data, Avell will contact you on the phone informed in your account.

Delivery time for the purchase will be considered after approval and eventual confirmation of the order.

Please be aware that:

Your credit card has a purchase limit set by the administrator. For the application to be approved, it is necessary that the limit on the card is equal to or greater than the total purchase price and not the value of each installment. Some requests may be denied for exceeding this limit and denial of purchase is not Avell's responsibility.

SHIPPING

The shipping costs are calculated based on delivery location, weight and dimensions of each product purchased.

To calculate the shipping costs:

Select BUY next to the chosen product. You will be directed to the shopping cart, enter the zip code in the field on the left side, just below the product.

Select OK and the shipping costs will be updated.

FREE SHIPPING covers only products that participate in a promotional activity, described on Avell's website or in any promotional material sent by the store.

If you purchase in the same order another product not included in the promotion, the shipping costs of this product will be charged as usual.

 

Warranty

To ensure your peace of mind, Avell offers a 1-Year Warranty to guarantee coverage of expenses for repairs or replacement of parts, defective parts or battery, and a 3-Years related to labor for your product.

The warranty is valid only in national territory. The customer is responsible for covering the expenses of sending the product abroad or taxes on the replacement product, as well as their components.

The Extended Warranty Insurance coverage period is described in the Certificate of Insurance Policy and starts from issuance of Invoice, having validity over the next 12 months.

WARRANTIES (WHAT IS COVERED)

The basic coverage of the Extended Warranty Insurance covers the compensation of total labor costs and parts replacement or components for repairing the affected product at the occurrence of a defect.
